Posted on the 6th of July, 2021 Disturbing the peace is referred to as police code 415 in the state of California, and it is considered a criminal offense.If you are disrupting the peace by playing overly loud music, arguing with someone, or using rude or threatening words, you are breaking the law.The number originates from the part of the state’s Penal Code that pertains to the offense.A wobblette is someone who causes trouble in the peace.
It can be prosecuted as a misdemeanor or as an infraction, depending on the circumstances.
What is disturbing the peace in California?
- Unlawfully fighting someone else in public, or challenging someone else to fight in public, is considered a form of disturbing the peace. Other forms of disturbing the peace include maliciously and willfully disturbing someone else by making a loud and unreasonable noise, or using offensive words in public that are likely to provoke an immediate and violent reaction. 1
Unlawful fighting is one method of causing a disturbance in the peace. The following are the two components that California prosecutors must establish in order to obtain a conviction for illegal fighting:
- The defendant willfully and unlawfully fought someone else or challenged someone else to fight, and both the defendant and the other person were in a public place or on school grounds at the time of the fight or challenge, and the defendant was not acting in self-defense or in defense of someone else when the fight or challenge occurred. 2
When a defendant fights someone ″willfully,″ it means that he or she did it on purpose or deliberately. 3
Playing loud music
Making excessive noise may likewise be a source of concern for the peace. This is frequently caused by playing music at an extremely loud volume. In order to obtain a conviction in California, prosecutors must establish two elements beyond a reasonable doubt:
- A loud and outrageous noise was intentionally and deliberately made by the defendant, and the noise caused a disturbance to someone else. 4
- To be considered sufficiently disturbing someone else in order to be considered criminal, either: there must be a clear and present threat of immediate violence, or the noise must be made with the intent of disrupting legitimate activity rather than as a method of communication. 5
- In order to be deemed ″maliciously negligent,″ the defendant must have behaved with the purpose to: conduct something wrong, damage or irritate someone else. 6
Using provoking language
- It is possible to disturb the peace by using offensive statements that are intended to cause violence. The prosecutor must establish the following elements of the offense: the defendant used offensive words that were inherently likely to provoke an immediate and violent reaction
- the defendant used those words while in a public place or on school grounds
- and the defendant used those words while in a public place or on school grounds. 7
- Inherently, words have the potential to elicit an immediate and violent reaction if the defendant said something that was reasonably likely to provoke another to react violently, and if, at the time the defendant made the statement, there was a clear and present danger that the other person would immediately react violently. 8
It is important to note that the defendant does not have to have intended to elicit a violent response. 9
What is a police code?
- When it comes to criminal offenses, a police code is a concise explanation of a specific scenario or prospective criminal conduct. They are used by police officers as radio codes to communicate information to other officers. This will aid them in their investigational efforts. In order for officers to properly prepare for events while on the road, the police department will employ codes. They can also be of assistance during stakeouts. Police code 415 is used in the case of a suspected disturbance of the peace. Similar police codes are used for specific types of disturbances, such as: 415b, which is used for an unknown type of disturbance
- 415c, which is used for a disturbance of the peace involving children

What are the penalties of a conviction?
- In California, disturbing the peace is considered a wobblette. These charges can be prosecuted as a misdemeanor or as a noncriminal infraction, depending on the circumstances. In determining how to proceed with the charge, prosecutors will consider the following factors: the unique circumstances of the case
- the defendant’s criminal history
- and the defendant’s plea bargain.
- If you are charged with a misdemeanor, you might face up to 90 days in county prison and/or $400 in fines if you are convicted. 10
- For those who commit their crimes on college or school grounds, or who have a prior conviction for disturbing the peace, additional penalties may be imposed, such as up to 6 months in county jail or $1,000 in fines. 11
However, if the incident occurred on college or school grounds, and the defendant has a prior conviction for disturbing the peace, the penalties escalate to: up to 6 months in county prison, and/or; a fine of up to $1,000. 11;
Are there any legal defenses?
- When facing a charge of disturbing the peace, there are various powerful legal defenses that may be utilized to your advantage. A few of the most popular defenses are: self-defense, lack of a reasonable idea that the statements would provoke a violent reaction, and First Amendment protection for the speech.
- Prosecutors must establish that the defendant did not act in self-defense in order to proceed. They must be able to demonstrate this beyond a reasonable doubt. 14 It is necessary for the defendant to have reasonably believed that he or she was in imminent danger of suffering bodily injury, to have reasonably believed that the use of immediate force was necessary to prevent that bodily injury, and to have used no more force than was reasonably necessary in order to establish that he or she was acting in self-defense 15
If the defendant did not act in self-defense, the prosecution must prove this to the jury.To be successful, they must prove their case beyond any reasonable reasonable question.14 When a defendant acts in self-defense, the defendant must have reasonably believed that he or she was in imminent danger of suffering bodily injury; must have reasonably believed that the immediate use of force was necessary to prevent that bodily injury; and must have used no more force than was reasonably necessary to prevent that bodily injury.15;
